Australia

  • Code Of Conduct (AU)

VisaEnvoy’s migration agents are all registered with MARA which is responsible for administering the Code of Conduct. The Code is intended to regulate the conduct of migration agents. VisaEnvoy provide expert immigration advice and visa services worldwide for the temporary or permanent entry to Australia for expatriates, executives and other professionals. Registered Migration Agents are required to have a sound knowledge of migration law and procedure and are required to conduct themselves in accordance with the Migration Agent’s Code of Conduct.

There is a new Code as of 1 March 2022: Download the new Code of Conduct for registered migration agents (PDF) or here: https://www.mara.gov.au/tools-for-registered-agents/code-of-conduct

  • Consumer Guide (AU)

Consumer Guide briefly highlights the most important elements of your relationship with your VisaEnvoy migration agent. Prior to commencing work for a new client a Registered Migration Agent is required by law to provide the client with a copy of a booklet entitled Consumer Guide. This booklet can be found online here.

  • Who can give migration assistance?

Only certain people can help you with your visa application.  This help is called immigration assistance. If you appoint someone to give you immigration assistance, they must be either:

    • a registered migration agent
    • a legal practitioner
    • an exempt person.
  • Why We Choose Not to be a Migration Law Firm

Lawyers*: Unlike most migration agencies, we have Australian lawyers who specialise in immigration law on staff which we believe allows us to provide a superior service.  Immigration law is a highly specialised area of the law and even lawyers in law firms and QCs who hold full practising certificates are not allowed to advise on it, with some limited exceptions, unless they become registered migration agents and so submit to the regulation of the Migration Agents Registration Authority.  All of our advisers are registered migration agents, but many of them are not lawyers.  Because we are regulated by the MARA, most of our Australian lawyers do not also hold practising certificates from the legal regulator, and we have chosen not to structure ourselves as an immigration law firm, so even when you are dealing with one of our lawyers, a solicitor-client relationship will not arise, as we will explain to you in detail when you engage us.  Choosing not to be a migration law firm allows us to keep our costs down so that we charge substantially less for the same work than most migration law firms would. If your case does go to court, we can call on our networks of external lawyers to provide seamless representation.

New Zealand

  • Code of Conduct (NZ)

Licensed Immigration Advisers Code of Conduct sets out the required standards of professional and ethical conduct for licensed immigration advisers. It is developed by the Registrar of Immigration Advisers and approved by the Minister of Immigration in accordance with section 37(4) of the Immigration Advisers Licensing Act 2007.

  • Professional Standards (NZ)

New Zealand licensed immigration advisers are skilled people who have met immigration adviser competency standards and who follow a professional code of conduct. Your New Zealand immigration adviser must either be licensed with the Immigration Advisers Authority (the Authority) or exempt. To check if a person is licensed or to see exempt groups, visit the Authority’s website www.iaa.govt.nz. The professional standards booklet can be viewed here.

  • Online Visa Assessment Policy

Only candidates who we believe may be eligible for an Australian visa will be contacted to make a booking for a detailed visa assessment and consultation.

Australian immigration law is complex and conducting an appropriate initial assessment takes time. As such we charge a minimal fee.

Once we complete our initial review, if we believe the case has good prospects we can get started by sending you a quote for the full service. The amount will have the initial review payment deducted. If you then decide to proceed we will issue you an engagement letter and invoice to get the process underway.
